Sauna Comfort Affiliate Agreement

THE AGREEMENT: This Affiliate Agreement (“Agreement”) is provided by Sauna Comfort LLC (“Company”). Our primary website is located at the address listed above. This Agreement is a legal document between you and the Company that describes the affiliate relationship we are entering into. Please read and understand this document, and consult legal counsel if needed.

  1. DEFINITIONS

a) Company, Us, We: Refers to Sauna Comfort LLC, including its employees or legal agents. b) You, the Affiliate: Refers to you, the individual or entity participating in the Affiliate Program. c) Parties: Collectively refers to both the Company and the Affiliate. d) Affiliate Program: The program we’ve established for affiliate promotion. e) Affiliate Application: The completed form submitted for program inclusion. f) Website: Refers to https://www.SaunaComfort.com.

  1. ASSENT & ACCEPTANCE

By submitting an application, you confirm that you have read and agree to be bound by this Agreement, including any policies or legal documents referenced herein.

  1. AGE RESTRICTION

You must be at least 18 years old to join the Affiliate Program. You warrant that you meet this requirement.

  1. PROGRAM SIGN-UP

Applications must be submitted through https://www.saunacomfort.com/affiliate-registration/. Acceptance is at our sole discretion. We may reject or revoke access for any reason, including violations of our Acceptable Use Policy. Rejected applicants may not reapply.

  1. NON-EXCLUSIVITY

This Agreement does not create an exclusive relationship. You may work with other programs, and we may engage other affiliates.

  1. AFFILIATE PROGRAM

Upon acceptance, you must complete your account setup, including payout and tax information.

You are responsible for retrieving your unique tracking links from the Affiliate Dashboard. These links (“Links”) are tied to your affiliate identity and direct users to our website or product pages.

You agree to:

  • Use only Links generated through the Dashboard;
  • Promote Links only on approved platforms listed in your Affiliate Application (“Affiliate Site”);
  • Abide by all terms of this Agreement.

We reserve the right to modify, replace, or remove Links and promotional materials. We will notify you of significant changes via the Dashboard or email.

You will earn a 5% commission on Qualified Purchases, excluding taxes, shipping, and other non-product charges.

  1. MARKETING AND PROMOTIONAL GUIDELINES

You agree to:

  • Clearly disclose your affiliate relationship in all promotional content per FTC guidelines;
  • Avoid misleading claims and spam tactics.

You are prohibited from:

  • Bidding on Company trademarks in paid ads;
  • Impersonating the brand;
  • Engaging in cookie stuffing or unauthorized redirects.

  1. INTELLECTUAL PROPERTY

You may use Company trademarks, banners, and promotional materials solely for program promotion. You may not alter these materials or use them in any misleading or unauthorized way. All rights remain with the Company.

  1. SPECIFIC TERMS APPLICABLE

We reserve the right to deny or reverse commissions for purchases that do not meet our criteria.

Qualified Purchases must: a) Come through properly formatted Links; b) Originate from approved Affiliate Sites; c) Be associated with a unique user; d) Not be generated by bots or automated programs.

  1. PAYOUT INFORMATION

Payouts require accurate contact, tax, and payment details, including a completed W9 form.

Payment methods: PayPal or Store Credit.

You must:

  • Maintain accurate payout details;
  • Notify us promptly of any changes.

Payouts will be processed the following period after they accrue. Conditions for payout:

  • Commission total is at least $50;
  • Purchases are confirmed and past the 30-day return window.

Disputes must be submitted within 30 days of payout.

  1. REPORTS

You may access reports via the Dashboard. These may be subject to revision before payout.

  1. TERM, TERMINATION & SUSPENSION

This Agreement begins upon your acceptance into the Program and may be terminated by either party at any time.

You may only earn payouts while in good standing. Violations of this Agreement may result in termination and forfeiture of unpaid commissions.

Provisions that naturally survive termination shall remain in effect.

  1. RELATIONSHIP OF THE PARTIES

Nothing in this Agreement creates a partnership, agency, or employment relationship. You are an independent contractor and responsible for your own taxes and obligations.

  1. MODIFICATIONS

We may modify this Agreement at any time. Notice of changes will be provided via email or the Dashboard. Continued participation signifies acceptance of the updated terms.

  1. LIMITATION OF LIABILITY & INDEMNIFICATION

We are not liable for indirect, incidental, or consequential damages. You agree to indemnify and hold us harmless from any claims or liabilities arising from your participation in the Program.

  1. GOVERNING LAW & JURISDICTION

This Agreement is governed by the laws of the State of Wisconsin. Legal actions shall be brought in the courts located in Brown County, Wisconsin.
